OK – that’s straightforward – because the STS proposal is within a European designated site and there is potential to affect the interests of the site, an Appropriate Assessment is required. The information to inform the Appropriate Assessment is usually produced by the consultants although it is the MCA as the competent authority that makes the final assessment based on the advice of SNH. It would appear the consultants didn’t think to submit an Appropriate Assessment. Does that fill you with confidence?
